Tbe language and logic of this part of the argument
were alike faultless and irresistible. Having applied to
tbe rebellious States the test of public law, and tbe derision of our Supreme Court, he summed up this portioo of his argument by saying tbat " u p to the time
military power was broken by tbe universal surrender of
their armies, and tbe universal trailing of their unhonored flag, tbe States were hostile States, and the citizens
public enemies," with belligerent rights and belligerent rights only, entitled to claim no benefits from the
laws or constitution, whether that constitution be colled
a compact, a treaty, or a covenant, or whether the parties to it were Sta{ee in their sovereign capacity, or the
